Please join KDC on Friday, July 23 at 12:00 p.m. eastern time for a virtual roundtable discussing the case of Jewish Hospital v. Perry, 2020-SC-0011, which was just recently decided by the Kentucky Supreme Court in June. In Jewish Hospital, the Kentucky Supreme Court was asked to interpret the scope of the peer-review privilege found in KRS 311.377(2) in light of its 2018 amendment. This was the first Supreme Court review of KRS 311.377(2) since its amendment. The Court held that "any documents created by an entity engaged in the retrospective review of the professional conduct of health care providers." Our panelists will discuss the background of the case, the Court's opinion, and its implication for defense attorneys—specifically, how to preserve the privilege and what documents or information may or may not be protected by the privilege. Attendees will have an opportunity throughout the program to openly engage with the panelists and one another as we discuss the scope of Kentucky's peer-review privilege and what lies ahead for those practicing in medical malpractice or other areas of healthcare defense. Many thanks to Paul Lawless of Bell Orr Ayers & Moore for organizing this program. Joey Wright, who handled the trial court motion practice and appeal in Jewish Hospital, will moderate this program. In response to some prior questions, we will not be recording these sessions and we do not apply for CLE credit. No registration is required, just a KDC membership. We will be sending out a link a day or two before the program that can be used if you are able to join us. Also, if you visit the Members Only section of the website, the link is posted there as well.
